Protections of a Domestic Violence Injunction
Tampa Domestic Violence Attorney
If you have been the victim of physical, emotional, sexual or financial abuse, or if you fear immediate, violent harm by another, you have the right to file a domestic violence injunction. If the person who is threatening you or who has actually harmed you is someone you live with, such as a spouse, someone you lived with previously, an ex-spouse, a blood relative or a relative by marriage, or someone who is the parent of your child or children – even if you have not lived with that person – you may petition for an
injunction for protection against domestic violence.
A Tampa domestic violence lawyer from the Givens Divorce Law Group can help you file your petition. Our firm has over 110 years of collective experience protecting people like you who have been harmed by those who are guilty of
child abuse,
elder abuse and
spousal abuse.
How does a domestic violence injunction protect you?
The injunction can protect you by:
- Forcing the abuser to leave the residence that you share.
- Order the abuser not to have any contact with you, either by phone or face to face, at your home, workplace, school or at a specified location. The order can be written to also protect your children or other family members.
- With rare exceptions, if you have minor children, you will be granted custody of them.
The main purpose for filing the injunction is for the domestic violence and the abuse to stop and for you and your family to be safe and protected. This temporary injunction is good for 15 days during that time you can meet with your attorney and come up with an action plan for putting your life back in order. After that period the judge will review the order and decide if it should be made permanent. We can help you and your children go to a shelter, or start divorce proceedings and work out any child custody arrangements. Filing a domestic violence injunction will give you the breathing room and peace of mind you need to take a look at your life and decide what the next step will be, and then the next step after that.
